Users Terms and Conditions

These are the terms and conditions on which you are offered access to In2culture and its search and booking services for activities, attractions, products and services ("Services") If you do not accept these terms and conditions, you must refrain from using In2culture and its online services.

By using the Services you acknowledge that you have read and understood, and agree to be bound by these terms and conditions ("Terms"). You must be at least eighteen (18) years old to use the Services.

1.1 The Services provided by In2culture may comprise:
1.1.1 Search and reservation functions via our website (www.campertravel.com.au) ("Website");
1.1.2 Payment processing, documentation and ticketing services.
1.2 Third Parties, by advertising on our website may provide travel related products, goods and other services ("Products"), to you that is accessed by our Services.
1.3 In2culture sell various travel related products and other goods and services as an agent on behalf of numerous transport, accommodation and other service providers ("Service Providers"). In2culture's obligation is to arrange relevant contracts between you and Service Providers. We have no responsibility for these Products nor do we make or give any warranty or representation regarding their standard. All bookings and sales are made subject to the terms and conditions and limitations of liability imposed by these Service Providers. Your legal recourse is against the specific Service Provider and not In2culture. If for any reason, any Service Provider is unable to provide the services for which you have contracted your remedy lies against the Service Provider and not with In2culture.
2.1 All of the Products accessible through the Website are provided by Service Providers. This material does not form part of the Services, and In2culture is not responsible for this material. In2culture does not warrant, and disclaims any liability for the accuracy or completeness of the information provided by Service Providers in relation to their Products.
2.2 Information provided through the Website is provided in good faith, and is subject to amendment at any time without notice.
2.3 You should make your own evaluation of the accuracy or completeness of any information, opinion, advice or other content available through the Website.
2.4 You should carefully read all the terms and conditions provided by the Service Provider specific to the Products you are booking before finalising your transaction.
3.1 You must only access and use the Services:
3.1.1 to make enquiries about and book or purchase Products on the Website (Permitted Purpose);
3.1.2 in accordance with these terms:
(a) have sufficient credit on your credit card account to meet all charges for the Products you book through the Booking Facility;
(b) keep secure any means of identification that In2culture provides to you in relation to your specific booking;
(c) comply with all requirements for the Product you've booked, including any terms and conditions (where applicable).
3.2 You must not:-
3.2.1 access or use the Services:
(a) for any activities which breach any laws, infringe any third party's rights, or breach any standards, content requirements or codes promulgated by any relevant authority;
(b) in any way which interferes with other users or defames, harasses or menaces anyone;
(c) for any purpose (commercial or otherwise) other than the Permitted Purpose without the express written permission of In2culture, including any reproduction, data mining, automated querying or similar data extraction processing;
3.2.2 reverse or cancel a payment without In2culture's prior written consent;
3.2.3 resell the Services, Products or any other products and services accessed by means of the Services; or
3.2.4 permit any other person to use your user identification to access the Services, or grant a third party the right to access and use the Services.
3.3 You are solely responsible for:
3.3.1 assessing the suitability of any Products for your needs; and
3.3.2 all matters relating to complying with the laws and regulations of all immigration authorities of the countries you travel to and from.
4.1 Payments
4.1.1 Bookings must be paid in full in order to purchase the Product(s).
4.1.2 By clicking "Pay Now", you accept:
(a) the fees and charges payable to In2culture and its related entities, set out in the payment summary, and
(b) the Service Providers offer to sell the Products to you for the price set out in your shopping cart, and subject to these terms and any applicable Product terms; and
(c) consent to In2culture supplying your billing, payment and identification information (including personal information) to those Service Providers who will supply the Products and accept that the recipients of this disclosure may not have in place privacy policies equivalent to In2culture's.
Your booking is not confirmed until full payment is received by In2culture and confirmation is provided to you by In2culture or the Service Providers with a confirmation or booking number for each element of the Product(s) booked.
4.2 Transaction Verification
4.2.1 You:
(a) Authorise In2culture's agents to:

charge all fees incurred to the credit card designated by you;

disclose your credit card details to, and obtain information from, any financial institution or credit card issuer to verify the credit card and identification details that you provide;

take steps to confirm that there is sufficient credit on your credit card account to meet likely charges;

(b) Authorise your credit card issuer or financial institution to verify that the credit card and identification details you have provided to In2culture are accurate; and
(c) Consent to In2culture supplying your billing, payment and identification information (including personal information) to those Service Providers who will supply the Products.
(d) Before In2culture proceeds to process any booking or purchase on your behalf or issues your documentation, various checks are taking place to validate the integrity of credit card information and in certain circumstances the credit card holder will be required to submit verification documentation to substantiate identity.
(e) If your credit card is not approved In2culture may attempt to contact you. Where In2culture cannot contact you, In2culture will have no choice but to cancel the booked arrangements. Under these circumstances In2culture accepts no responsibility for any re-booking costs.
(f) In2culture reserves the right at its absolute discretion to decline or accept bookings or purchases. Any automatic confirmations for such bookings or purchases are conditional contingent on In2culture's view of any financial risks, potential delays, or other regulations that may apply.
(g) If payment is not received for your confirmed booking for any reason, you agree to pay In2culture all amounts due on demand.
4.3 Refunds
4.3.1 Your right to a refund is governed by the terms and conditions of the applicable Service Provider. Products may be non-refundable and the Service Provider may charge cancellation fees to your particular Product.
4.3.2 In2culture shall only be liable to provide a refund to you to the extent that it actually receives a refund from the relevant Service Provider. Where refunds are due to you from a Service Provider, In2culture will provide reasonable assistance to you in claiming such funds from that Service Provider. In that situation, In2culture is authorised (but not obliged) to seek such refunds from the Service Provider directly and on its own behalf.
4.3.3 Where a refund is applicable, the turnaround time from the date of your request for refund to the date you are provided with your refund may take up to 12 weeks. This is beyond the control of In2culture.
4.4 Fees
The following fees may be charged to you by In2culture:-
4.4.1 Payment Fee
(a) In2culture may charge you a Payment Fee in relation to processing your booking and accepting payment.
(b) Payment Fees are charged by In2culture in its own capacity (as merchant), and not as an agent for any other party. Payment Fees cover a range of costs, services, fees and charges in relation to your booking, including (among other things for example fraud prevention) the reasonable costs of accepting card payments. Payment Fees will be itemised on the checkout page after a payment method has been selected.
4.4.2 Servicing Fee
(a) The servicing fee included in your booking payment summary is non-refundable and will be charged to you within 24 hours ("ervicing Fee"). Funds need to be available on your card at the time of making the booking otherwise ticketing will not take place.
(b) The Servicing Fee provides you access to our customer service function.
(c) The Servicing Fee covers a range of costs, services, fees and charges in relation to providing you with customer service in relation to your booking and includes GST.
4.4.3 Cancellation Fees
(a) In2culture reserves the right to charge amendment or cancellation fees depending on circumstances and Service Provider conditions.
4.4.3 Commission
(a) You acknowledge and agree that In2culture may receive a commission or an affiliate fee or a marketing fee from transactions entered into by you using the Services.
5.1 Non-excludable Obligations
5.1.1 Certain laws imply terms (Non-excludable Obligations) into contracts for the supply of goods or services that cannot be excluded.
5.1.2 Except in relation to Non-Excludable Obligations:
(a) In2culture makes no representations, warranties or guarantees in relation to the Product or the availability, continuity, reliability, accuracy, currency or security of the Services; and
(b) all warranties and other terms which are not expressly included in these terms and conditions are excluded to the maximum extent permitted by law.
5.2 Exclusions
5.2.1 To the maximum extent permitted by law, In2culture excludes all liability (including for negligence) for direct, indirect, consequential or incidental damages, lost profits or savings or damages for disappointment.
5.2.2 To the maximum extent permitted by law, In2culture is not responsible or liable (including for negligence) to you for:
(a) any technical errors, corruption of data, unauthorised access to your personal data, inaccuracies in information supplied by third parties including by Service Providers, or failure by In2culture to complete bookings (including if the Services are not available for any reason) where that failure is due to circumstances beyond its control;
(b) the quality of the products, or any inconvenience caused or expense incurred to you or any third party as a result of any unsuitability of Products for your needs, including for use in association with other services;
(c) any failure or delay on the part of any Service Provider in providing Products to you where your booking has been properly processed;
(d) any acts or omissions of Service Providers, or other third parties in the course of delivery of any Products, except to the extent that responsibility for those matters may be imposed on In2culture by legislation that cannot be excluded.
5.2.3 Risk Warning
(a) Some of the products available on the website are recreational services (as that term is defined in the Competition and Consumer Act 2010 (Cth)) you are undertaking for the purposes of enjoyment, leisure or relaxation. You acknowledge that the recreational services are inherently dangerous and involve risks. The risks associated with participation in the recreational services can and often do happen which may result in personal injury, death, illness, aggravation of an existing illness, disease, property damage or economic loss. The risks include but are not limited to:

(i) sudden movements, jarring and hard landings associated with travelling in vehicles in remote parts of Australia;

(ii) greater than usual physical exertion placing people at an increased risk of personal injury, trauma or death;

(iii) exposure to the natural elements which can be unpredictable and potentially harmful or fatal, such as exposure to uneven terrain, slippery rocks and bush tracks, storm, wind, tide, current, heat, getting wet and flora and fauna (including exposure to snakes and microorganisms);

(iv) participation in recreational services conducted at locations that are remote in time, distance and/or accessibility from any medical treatment facility; and

(v) other risks of or incidental to the recreational services or activities ancillary to the recreational services.

(b) You have been advised of the risks associated with the recreational services and voluntarily choose to participate in the recreational services fully accepting that the materialisation of such risks may cause personal injury, death, illness or aggravation of an existing illness. You agree and undertake any such risk voluntarily and at your own risk.
(c) You consent to be evacuated and to the provision of first aid and medical treatment if you are injured or become ill and agree to pay for such evacuation or provision of service.
5.2.4 Exclusion of Warranty
(a) A supplier of recreational services can ask you to agree that statutory guarantees contained in sections 60 and 61, Subdivision B, Division 1, Part 3-2, Schedule 2 of the Competition and Consumer Act 2010 (Cth) (the "Australian Consumer Law") do not apply to you (or a person for whom or on whose behalf you are acquiring the services).
(b) By accepting these conditions, you agree that the statutory guarantees contained in sections 60 and 61 of the Australian Consumer Law which provide that the services will be rendered to you with due care and skill, be fit for a particular purpose and achieve a desired result are expressly excluded for the supply of recreational services (as that term is defined in the Competition and Consumer Act 2010 (Cth)) by the Service Provider and In2culture to you if those recreational services cause or contribute to you suffering any of the following:

(i) death;

(ii) physical or mental injury (including the aggravation, acceleration or recurrence of such an injury of the individual);

(iii) the contraction, aggravation or acceleration of a disease of an individual;

(iv) the coming into existence, aggravation, acceleration or recurrence of any other condition, circumstance, occurrence, activity, form of behaviour, course or conduct of state affairs in relation to an individual:

  • i. that is or may be harmful or disadvantageous to the individual or community; or
  • ii. that may result in harm or disadvantage to the individual or community,

    unless you suffer a significant personal injury that is caused by the reckless conduct, as that term is defined in section 139A(5) of the Competition and Consumer Act 2010 (Cth), of the Service Provider or In2culture.
5.3 Limitation of Liability
5.3.1 To the maximum extent permitted by law, in no event shall the In2culture, and/or their respective suppliers be liable for any direct, indirect, punitive, incidental, special, or consequential damages arising out of, or in any way connected with, your access to, display of or use of this Website or with any delay or inability to access, display or use this Website (including, but not limited to, your reliance upon opinions appearing on this Website; any computer viruses, information, software, linked sites, products, and services obtained through this Website; or otherwise arising out of the access to, display of or use of this Website) whether based on a theory of negligence, contract, tort, strict liability, consumer protection statutes, or otherwise, and even if In2culture and/or their respective suppliers have been advised of the possibility of such damages.
5.3.2 In relation to any liability which cannot be exclude by law or despite the limitation above, if In2culture or their respective suppliers are found liable for any loss or damage which arises out of or in any way is connected with any of the occurrences described above, then to the maximum extent permitted by law In2culture liabilities will in no event exceed, in the aggregate, the greater of (a) the service fees you paid to In2culture connection with such transaction(s) on this website, or (b) One-Hundred Dollars (AU$100.00).
5.3.3 The limitation of liability reflects the allocation of risk between the parties. The limitations specified in this section will survive and apply even if any limited remedy specified in these Terms is found to have failed of its essential purpose. The limitations of liability provided in these Terms endure to the benefit of In2culture.
5.3.4 If any warranties are implied by law that cannot be excluded, then to the maximum extent permitted by law our liability for breach of such warranties is limited to, at our option:
(a) in the case of Products:
  • the replacement of the Products or the supply of equivalent Products;
  • the payment of the cost of replacing the Products or acquiring equivalent Products;
(b) in the case of Services:
  • the supply of the Services again;
  • the payment of the cost of having the Services supplied again.
5.4 Indemnification
You agree to defend and indemnify the In2culture, and/or their respective suppliers and any of their officers, directors, employees and agents from and against any claims, causes of action, demands, recoveries, losses, damages, fines, penalties or other costs or expenses of any kind or nature including but not limited to reasonable legal and accounting fees, brought by third parties as a result of:
(a) your breach of this agreement or the documents referenced herein;
(b) your breach of any law or the rights of a third party; or
(c) your use of this Website.
Where our site has included information and links to other web sites, the inclusion of these external links does not in any way endorse commercial products or services found on those websites. Links to other sites represent exit points from cairnsvisitorcentre.com and visitors to our site visit other websites at their own discretion and risk.
6.1 Errors & Omissions
6.1.1 We reserve the right to amend your booking in consultation with you where an error or omission was made in relation to the product or services purchased and;
(a) the error/omission was made in circumstances outside our control; or
(b) the error/omission was made by the Service Provider and they have advised that they are unable to provide the purchased Products at the price advertised or at all; or
(c) the error/omission made by us or the Service Provider leads to a material and unreasonable outcome.
6.1.2 We publish all content on our sites in good faith; however, all content is provided by Service Providers and we do not check or verify the accuracy of this information. Quality ratings provided are for information purposes only, vary considerably from one country to another, and are not a guarantee or warranty of any kind. For instance:
(a) Quality ratings may be based on a range of subjective or objective criteria and as such, our ratings are not guaranteed to be consistent with ratings found on other third party sites;
(b) Information related to mapping and distances are also provided for information purposes only and are not a guarantee or warranty of any kind of the hotel's location;
(c) we do not check or verify images displayed on our site and may depict tour sites and services, not the actual Product offered by the Service Provider.
6.1.3 Errors and omissions on our sites are corrected upon learning of the same. We reserve the right to cancel any reservation without liability or penalty to you, if an error or omission occurs in any of the circumstances outlined above.
It is strongly recommended that travel insurance be acquired at the time of booking. Insurance should cover loss of costs through cancellation, loss of personal belongings, baggage, money and medical expenses.
8.1 GST
8.1.1 All prices on the site are inclusive of GST unless stated otherwise.
8.1.2 For this clause the Term "GST" means any tax, levy, charge, or impost implemented under the A New Tax System (Goods and Services Tax) Act 1999 (Cth) or an Act of the Parliament of the Commonwealth of Australia substantially in the form of or which has a similar effect to the GST Act.
8.2 Changes to these Terms

In2culture may amend these terms at any time by posting the revised version of the agreement to the Website. The amended agreement will take effect from the time of posting on the Website.

8.3 Assignment

You must not novate or assign any of your rights under these terms to a third party.

8.4 Governing Law

These terms are governed by the laws in force in Queensland, Australia. You irrevocably submit to the non-exclusive jurisdiction of the courts of Queensland and courts of appeal from them for determining any dispute concerning these terms.

8.5 Entire Agreement

These terms and conditions constitute the entire agreement between the parties in relation to their subject matter.
